Wade. <em>(Speaking of the &#8220;ongoing\u00a0<a href=\"https:\/\/search.aol.com\/click\/_ylt=A0geKI64bIliC.wAw2BpCWVH;_ylu=Y29sbwNiZjEEcG9zAzEEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1653202233\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fCulture_war\/RK=0\/RS=n93x.gx1Agken3SJ9hPD2DaOmz0-\" target=\"_blank\" rel=\"noreferrer noopener\">Culture war<\/a>,&#8221; as noted in the last post.) <\/em>I found a draft post from some time ago, titled &#8220;Why not 12 Supreme Court Justices?&#8221;<\/p>\n<p>Which leads to what <a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=AwrEk5faKrditU8AGD1pCWVH;_ylu=Y29sbwNiZjEEcG9zAzIEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1656200027\/RO=10\/RU=https%3a%2f%2fwww.britannica.com%2fbiography%2fAlexis-de-Tocqueville\/RK=0\/RS=Il4AGpT9rmffbfWMr2rdIASlbGI-\" target=\"_blank\" rel=\"noopener\" data-matarget=\"algo\" data-b13=\"62b72adb540a8\">Alexis de Tocqueville<\/a> once wrote. He said the U.S. president may slip without the state suffering, and Congress may slip without the Union perishing, because both can be replaced by the voters. But if ever the Supreme Court &#8220;came to be composed of rash or corrupt men, the confederation would be threatened by anarchy or civil war.&#8221;<\/p>\n<p>To many Americans, that prophecy just came true. <em>(Thus the &#8220;chaos&#8221; image atop the page.)\u00a0<\/em><\/p>\n<p>But taking the long view, <a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=A0geKYr3XbdifUgA9edpCWVH;_ylu=Y29sbwNiZjEEcG9zAzQEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1656213112\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fDobbs_v._Jackson_Women%2527s_Health_Organization\/RK=0\/RS=DKkbGjd.kt67jTx3EoPHMpVijHM-\" target=\"_blank\" rel=\"noopener\" data-matarget=\"algo\" data-4c1=\"62b75df8232d5\">Dobbs v. Jackson Women&#8217;s Health Organization<\/a> won&#8217;t be the end of the story. This judicial effort to &#8220;turn back the clock&#8221; will lead to a strong reaction &#8211; as it has already &#8211; if not a strong &#8220;blue wave&#8221; some time in the foreseeable future. Which leads to the question, &#8220;How can we offset a way-too-conservative Supreme Court?&#8221;<\/p>\n<p>For starters, there <strong><em>are<\/em><\/strong> ways to avoid or sidestep an unpopular &#8220;dictate from above,&#8221; in the form of a High Court decision. Just think of <a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=AwrJ7FsZKLdiuhIAeF9pCWVH;_ylu=Y29sbwNiZjEEcG9zAzQEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1656199322\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fBrown_v._Board_of_Education\/RK=0\/RS=6Ahi.fo9uuXxZN0Fvqbb8YHIwh0-\" target=\"_blank\" rel=\"noopener\" data-matarget=\"algo\" data-d09=\"62b7281a21b49\">Brown v. Board of Education<\/a>. In 1954, the then-Supreme Court ruled that &#8220;<a title=\"\" href=\"https:\/\/en.wikipedia.org\/wiki\/U.S._state\">U.S. state<\/a>\u00a0laws establishing\u00a0<a title=\"Racial segregation\" href=\"https:\/\/en.wikipedia.org\/wiki\/Racial_segregation\">racial segregation<\/a>\u00a0in\u00a0<a class=\"mw-redirect\" title=\"Public school (government funded)\" href=\"https:\/\/en.wikipedia.org\/wiki\/Public_school_(government_funded)\">public schools<\/a> are unconstitutional.&#8221; The court added that states had to integrate &#8220;<a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=AwrJ7Jy8KLdicFMATi9pCWVH;_ylu=Y29sbwNiZjEEcG9zAzEEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1656199484\/RO=10\/RU=https%3a%2f%2fbrewminate.com%2fwith-all-deliberate-speed-brown-v-board-and-the-end-of-racial-school-segregation%2f\/RK=0\/RS=OVUOeJ1rrdtcOzhAiLSZrcpXu64-\" target=\"_blank\" rel=\"noopener\" data-matarget=\"algo\" data-aee=\"62b728bc7cdb8\">With All Deliberate Speed<\/a>.&#8221; In response, &#8220;White citizens in the South organized a &#8216;<a href=\"https:\/\/www.khanacademy.org\/humanities\/history\/euro-hist\/civil-rights-movement\/a\/massive-resistance-and-little-rock\" target=\"_blank\" rel=\"noreferrer noopener\">Massive Resistance&#8217;<\/a> campaign against integration.&#8221; Almost 70 years later, we seem to be moving <strong><em>backward<\/em><\/strong> on that project.<\/p>\n<p>Here\u2019s another example of <strong><em>some<\/em><\/strong> Americans getting around such \u201corders from above:\u201d\u00a0<\/p>\n<blockquote>\n<p>Making alcohol at home was very common during <a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=AwrE19JOKrdiCooAbStpCWVH;_ylu=Y29sbwNiZjEEcG9zAzMEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1656199887\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fProhibition_in_the_United_States\/RK=0\/RS=Ofa68XV109H6wW4ABLV.XPuukC8-\" target=\"_blank\" rel=\"noopener\" data-matarget=\"algo\" data-459=\"62b72a4f67b21\"><strong>Prohibition<\/strong><\/a>. Stores sold grape concentrate with warning labels that listed the steps that <b>should be avoided<\/b> to prevent the juice from fermenting into wine\u2026 The grape concentrate was sold with a warning: \u201cAfter dissolving the brick in a gallon of water,\u00a0<b>do not<\/b>\u00a0place the liquid in a jug away in the cupboard for twenty days, because\u00a0<strong>then it would turn into wine<\/strong>.\u201d<\/p>\n<\/blockquote>\n<p>You have to love a country where that happens. <em>(&#8220;The popular will?&#8221;) <\/em>Another thought: <a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=A0geKYr3XbdifUgA9edpCWVH;_ylu=Y29sbwNiZjEEcG9zAzQEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1656213112\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fDobbs_v._Jackson_Women%2527s_Health_Organization\/RK=0\/RS=DKkbGjd.kt67jTx3EoPHMpVijHM-\" target=\"_blank\" rel=\"noopener\" data-matarget=\"algo\" data-4c1=\"62b75df8232d5\">Dobbs<\/a> just means that instead of one big battle, the combatants will now face 50 smaller battles.<\/p>\n<p>Which brings us back to how to further side-step the current Court majority, of young and ardent conservatives. One answer: Court-packing. See <a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=A2KLfSjgJ4dfBDAA5QlpCWVH;_ylu=Y29sbwNiZjEEcG9zAzQEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1602721889\/RO=10\/RU=https%3a%2f%2fblogs.findlaw.com%2flaw_and_life%2f2019%2f10%2fwhat-is-court-packing-and-why-does-it-matter.html\/RK=0\/RS=D6xfEDnJZpRqVZmiSPVPhQTeOIs-\" target=\"_blank\" rel=\"noopener\" data-28f=\"5f8727e15b910\">What is Court Packing &#8230; FindLaw<\/a>:<\/p>\n<blockquote>\n<p>Article III of the U.S. Constitution &#8230;\u00a0<a title=\"Packing the Supreme Court explained\" href=\"https:\/\/constitutioncenter.org\/blog\/packing-the-supreme-court-explained\">gives Congress broad discretion for establishing the structure of the judicial branch<\/a>. The first court had six justices, before President John Adams and the Congress reduced the number of justices to five. The number of judges\u00a0then fluctuated until it hit nine in 1869, where it has remained&#8230;\u00a0So, it wouldn&#8217;t take a constitutional amendment to change the number of justices. Congress would simply have to pass a law, and the president would need t<a title=\"Senate Pulls 'Nuclear' Trigger To Ease Gorsuch Confirmation\" href=\"https:\/\/www.npr.org\/2017\/04\/06\/522847700\/senate-pulls-nuclear-trigger-to-ease-gorsuch-confirmation\">o sig<\/a>n it.<\/p>\n<\/blockquote>\n<p>Given all that, at some time in the foreseeable future a Democratic Congress and President <strong><em>could<\/em> <\/strong>pass a law making the Court consist of 12 justices rather than nine. And there is ample precedent, including Biblical: 12 Apostles, 12 tribes of Israel, and in Common Law &#8211; for the longest time 12 people served on a traditional jury in England and America. <em>(Before conservatives in many U.S. states to reduce the number to six, for ease of conviction.) <\/em><\/p>\n<p>Then there&#8217;s &#8220;<a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=A0geK.dyKIdfrxAAcYhpCWVH;_ylu=Y29sbwNiZjEEcG9zAzIEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1602722035\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fConsent_of_the_governed\/RK=0\/RS=V6SVPpYrvxsecVayhdBK2IKfSXk-\" target=\"_blank\" rel=\"noopener\" data-24e=\"5f87287339050\">Consent of the governed<\/a>.&#8221;\u00a0<\/p>\n<p>That&#8217;s the idea that a &#8220;<a title=\"Government\" href=\"https:\/\/en.wikipedia.org\/wiki\/Government\">government<\/a>&#8216;s\u00a0<a class=\"mw-redirect\" title=\"Political legitimacy\" href=\"https:\/\/en.wikipedia.org\/wiki\/Political_legitimacy\">legitimacy<\/a>\u00a0and\u00a0<a class=\"mw-redirect\" title=\"Natural and legal rights\" href=\"https:\/\/en.wikipedia.org\/wiki\/Natural_and_legal_rights\">moral right<\/a>\u00a0to use state power is only justified and lawful when consented to by the people or\u00a0<a title=\"Society\" href=\"https:\/\/en.wikipedia.org\/wiki\/Society\">society<\/a>\u00a0over which that\u00a0<a class=\"mw-redirect\" title=\"Political power\" href=\"https:\/\/en.wikipedia.org\/wiki\/Political_power\">political power<\/a> is exercised.&#8221; On that note, I&#8217;d say the <a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=A0geKYr3XbdifUgA9edpCWVH;_ylu=Y29sbwNiZjEEcG9zAzQEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1656213112\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fDobbs_v._Jackson_Women%2527s_Health_Organization\/RK=0\/RS=DKkbGjd.kt67jTx3EoPHMpVijHM-\" target=\"_blank\" rel=\"noopener\" data-matarget=\"algo\" data-4c1=\"62b75df8232d5\">Dobbs<\/a>\u00a0majority&#8217;s thinking that most Americans will meekly accede to such an activist, conservative shake-up greatly misunderstands American history &#8211; and the American national character.
