It&#8217;s one of those rare classic movies, like\u00a0<a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=AwrJ7JuS6mNfqcAATp9pCWVH;_ylu=Y29sbwNiZjEEcG9zAzIEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1600412434\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fCasablanca_%28film%29\/RK=0\/RS=.MG54r5Si5_6NmmZLFo4rn0K4M8-\" target=\"_blank\" data-f65=\"5f63ea92ad566\">Casablanca<\/a>, that I can watch over and over again. One law professor said it was\u00a0\u201cprobably the finest pure\u00a0<a title=\"Trial film\" href=\"https:\/\/en.wikipedia.org\/wiki\/Trial_film\">trial movie<\/a>\u00a0ever made.\u201d)<\/em><\/p>\n<p style=\"text-align: left;\">And one of my favorite <strong><em>characters<\/em> <\/strong>in this classic\u00a0<a class=\"mw-redirect\" title=\"Courtroom drama\" href=\"https:\/\/en.wikipedia.org\/wiki\/Courtroom_drama\">courtroom<\/a>\u00a0<a title=\"Crime film\" href=\"https:\/\/en.wikipedia.org\/wiki\/Crime_film\">crime film<\/a>\u00a0is<strong><em>\u00a0<a title=\"Joseph N. Welch\" href=\"https:\/\/en.wikipedia.org\/wiki\/Joseph_N._Welch\">Joseph N. Welch<\/a><\/em><\/strong>. He plays the judge presiding at the murder trial in Iron Bay, a resort town in the\u00a0<a title=\"Upper Peninsula of Michigan\" href=\"https:\/\/en.wikipedia.org\/wiki\/Upper_Peninsula_of_Michigan\">Upper Peninsula of Michigan<\/a>.<em> (The regular &#8220;<a title=\"Upper Peninsula of Michigan\" href=\"https:\/\/en.wikipedia.org\/wiki\/Upper_Peninsula_of_Michigan\">UP<\/a>&#8221; judge is indisposed, so Judge Weaver &#8211; Joseph Welch &#8211; is brought in from the\u00a0<a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=A0geK.j262NfzUUA64xpCWVH;_ylu=Y29sbwNiZjEEcG9zAzEEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1600412791\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fLower_Peninsula_of_Michigan\/RK=0\/RS=z3mJwgx5TlmMRUDPGYzDlupJY0I-\" target=\"_blank\" data-669=\"5f63ebf73672e\">Lower Peninsula<\/a>.)<\/em><\/p>\n<p style=\"text-align: left;\">Some background.\u00a0<a title=\"Ben Gazzara\" href=\"https:\/\/en.wikipedia.org\/wiki\/Ben_Gazzara\">Ben Gazzara<\/a>\u00a0plays Army Lieutenant Frederick Manion, who guns down a local tavern keeper, Barney Quill, an hour or more after Quill raped Manion&#8217;s wife Laura.<em> (Played by\u00a0<a title=\"Lee Remick\" href=\"https:\/\/en.wikipedia.org\/wiki\/Lee_Remick\">Lee Remick<\/a>.)<\/em>\u00a0<a title=\"James Stewart\" href=\"https:\/\/en.wikipedia.org\/wiki\/James_Stewart\">Stewart<\/a>\u00a0plays defense attorney Paul Biegler, who <strong><em>used<\/em><\/strong> to be the town prosecutor, but lost the election to Mitch Lodwick. <em>(Who feels that &#8211; due to the importance of the case &#8211; he needs to call in the help of state Assistant Attorney General Claude Dancer, played by\u00a0<a title=\"George C. Scott\" href=\"https:\/\/en.wikipedia.org\/wiki\/George_C._Scott\">George C. Scott<\/a>.)<\/em><\/p>\n<p style=\"text-align: left;\">Incidentally, both the film and novel that inspired it were based on an actual Michigan case in 1952. There the defense used the concept of &#8220;<a title=\"Irresistible impulse\" href=\"https:\/\/en.wikipedia.org\/wiki\/Irresistible_impulse\">irresistible impulse<\/a>&#8221; &#8211; based on an obscure 1886 state supreme court holding &#8211; to win an acquittal &#8220;by reason of insanity.&#8221;<\/p>\n<p style=\"text-align: left;\">Two days after trial <strong><em>that<\/em> <\/strong>defendant was judged to be sane by a psychiatrist and released. <em>(Only to be divorced by his wife, also soon after trial.)<\/em> In\u00a0<a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=AwrE1xcG6mNf1g8AAnRpCWVH;_ylu=Y29sbwNiZjEEcG9zAzIEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1600412295\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fAnatomy_of_a_Murder\/RK=0\/RS=j76G5TlGD_kHuUjPaOKfgwvUXRA-\" target=\"_blank\" data-0ab=\"5f63ea0757f04\">Anatomy<\/a>, Lt. Manion is released as well, but then he and his wife skip town before attorney Biegler can get the lieutenant to sign a promissory note for $3,000. <em>(The amount he agreed to pay Biegler while in jail awaiting trial.\u00a0But note, a &#8220;real&#8221; defense lawyer would have gotten the promissory note well before that, most likely before trial but at least right after the verdict. That&#8217;s why the call it\u00a0<a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=A2KIbNOmF2Rfj2EAKCxpCWVH;_ylu=Y29sbwNiZjEEcG9zAzcEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1600423974\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fPoetic_license\/RK=0\/RS=HCgu3U5zIofIovm2cNncSgJCF6A-\" target=\"_blank\" data-c3d=\"5f6417a6e20f4\">artistic license<\/a>.)\u00a0\u00a0<\/em><\/p>\n<p style=\"text-align: left;\"><img loading=\"lazy\" class=\"alignleft\" src=\"https:\/\/upload.wikimedia.org\/wikipedia\/commons\/5\/53\/McCarthy_Cohn.jpg\" width=\"288\" height=\"197\" \/>But back to <a title=\"Joseph N. Welch\" href=\"https:\/\/en.wikipedia.org\/wiki\/Joseph_N._Welch\">Joseph Welch<\/a>: Aside from playing Judge Weaver in\u00a0<a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=AwrE1xcG6mNf1g8AAnRpCWVH;_ylu=Y29sbwNiZjEEcG9zAzIEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1600412295\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fAnatomy_of_a_Murder\/RK=0\/RS=j76G5TlGD_kHuUjPaOKfgwvUXRA-\" target=\"_blank\" data-0ab=\"5f63ea0757f04\">Anatomy of a Murder<\/a>, he was a &#8220;real-life lawyer famous for dressing down\u00a0<a title=\"Joseph McCarthy\" href=\"https:\/\/en.wikipedia.org\/wiki\/Joseph_McCarthy\">Joseph McCarthy<\/a>&#8221;\u00a0&#8211; left, with counsel \u00a0<a title=\"Roy Cohn\" href=\"https:\/\/en.wikipedia.org\/wiki\/Roy_Cohn\">Roy Cohn<\/a>\u00a0&#8211; &#8220;during the\u00a0<a title=\"Army\u2013McCarthy hearings\" href=\"https:\/\/en.wikipedia.org\/wiki\/Army%E2%80%93McCarthy_hearings\">Army\u2013McCarthy hearings<\/a>.&#8221; For some background on <strong><em>that<\/em><\/strong>&#8230;<\/p>\n<p style=\"text-align: left;\">June 9, 1954. The hearings were in their 30th day, the result of\u00a0Senator\u00a0<a title=\"Joseph McCarthy\" href=\"https:\/\/en.wikipedia.org\/wiki\/Joseph_McCarthy\">Joseph McCarthy<\/a>&#8216;s &#8220;aggressive investigations of suspected Communists and security risks&#8221; within the U.S. Army.\u00a0<em>(As well as a counter-accusation that Committee Counsel\u00a0<a title=\"Roy Cohn\" href=\"https:\/\/en.wikipedia.org\/wiki\/Roy_Cohn\">Roy Cohn<\/a>\u00a0&#8211; at right in the photo above &#8211; had pressured the Army &#8220;to give preferential treatment to\u00a0<a title=\"G. David Schine\" href=\"https:\/\/en.wikipedia.org\/wiki\/G._David_Schine\">G. David Schine<\/a>, a former McCarthy aide and friend of Cohn&#8217;s.&#8221;)\u00a0\u00a0<\/em><\/p>\n<p style=\"text-align: left;\">Joseph Welch served as Army counsel, and on June 9 challenged Cohn to <strong><em>give<\/em><\/strong> his alleged list of &#8220;130 security risks&#8221; to the <a title=\"United States Attorney General\" href=\"https:\/\/en.wikipedia.org\/wiki\/United_States_Attorney_General\">U.S. Attorney General<\/a>. McCarthy responded that Welch should &#8220;check on\u00a0<a title=\"Fred Fisher (lawyer)\" href=\"https:\/\/en.wikipedia.org\/wiki\/Fred_Fisher_(lawyer)\">Fred Fisher<\/a>, a young lawyer in Welch&#8217;s own Boston law firm.&#8221; Fisher had once belonged to the\u00a0<a title=\"National Lawyers Guild\" href=\"https:\/\/en.wikipedia.org\/wiki\/National_Lawyers_Guild\">National Lawyers Guild<\/a>, in what Welch considered a youthful indiscretion. McCarthy insisted it was a &#8220;Communist front.&#8221; When McCarthy continued his attacks Welch responded:<\/p>\n<blockquote>\n<p style=\"text-align: left;\">Until this moment, Senator, I think I have never really gauged your cruelty or your recklessness. Fred Fisher is a young man who\u00a0&#8230; came into my firm and is starting what looks to be a brilliant career&#8230; Little did I dream you could be so reckless and so cruel as to do an injury to that lad. It is true he is still with Hale and Dorr&#8230; It is, I regret to say, equally true that I fear he shall always bear a scar needlessly inflicted by you. If it were in my power to forgive you for your reckless cruelty I would do so. I like to think I am a gentleman, but your forgiveness will have to come from someone other than me.<\/p>\n<\/blockquote>\n<p style=\"text-align: left;\"><img loading=\"lazy\" class=\"alignright\" src=\"https:\/\/upload.wikimedia.org\/wikipedia\/en\/c\/c6\/JosephNWelch.jpg\" alt=\"JosephNWelch.jpg\" width=\"142\" height=\"189\" \/>McCarthy tried to renew his attack on Fisher, but Welch interrupted. &#8220;Let us not assassinate this lad further, Senator. You&#8217;ve done enough. Have you no sense of decency, sir? <em><strong>At long last, have you left no sense of decency?&#8221; <\/strong><\/em>McCarthy tried to attack Fisher yet again, but Welch would have none of it. He refused to discuss the matter further, said that if there was a God in heaven it would do neither McCarthy nor his cause any good, then prompted the chairman to call the next witness. &#8220;At this, those watching the proceedings broke into applause.&#8221;<\/p>\n<p style=\"text-align: left;\"><strong><em>For one thing, I&#8217;d say we could use a lot more &#8220;Joseph Welch&#8221; in today&#8217;s political arena&#8230;<\/em><\/strong><\/p>\n<p style=\"text-align: center;\">* \u00a0 * \u00a0 * \u00a0 *<\/p>\n<p style=\"text-align: left;\">But what also struck me &#8211; as I watched Welch preside over the &#8220;<a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=AwrE1xcG6mNf1g8AAnRpCWVH;_ylu=Y29sbwNiZjEEcG9zAzIEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1600412295\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fAnatomy_of_a_Murder\/RK=0\/RS=j76G5TlGD_kHuUjPaOKfgwvUXRA-\" target=\"_blank\" data-0ab=\"5f63ea0757f04\">Anatomy<\/a>&#8221; trial &#8211; came when I started wondering how<strong><em> old<\/em><\/strong>\u00a0he was when he did the movie. &#8220;<em><strong>I&#8217;m guessing, what? 80? 85?<\/strong><\/em>&#8220;<\/p>\n<p style=\"text-align: left;\">I did some research, and learned that when Welch died he was <strong><em>way<\/em><\/strong> too close to how old I am now. Born in 1890, he played in\u00a0<a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=AwrE1xcG6mNf1g8AAnRpCWVH;_ylu=Y29sbwNiZjEEcG9zAzIEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1600412295\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fAnatomy_of_a_Murder\/RK=0\/RS=j76G5TlGD_kHuUjPaOKfgwvUXRA-\" target=\"_blank\" data-0ab=\"5f63ea0757f04\">Anatomy of a Murder<\/a>\u00a0in 1959, and died not long after that.\u00a0&#8220;Sixteen days before his 70th birthday, and fifteen months after the release of\u00a0<i><a title=\"Anatomy of a Murder\" href=\"https:\/\/en.wikipedia.org\/wiki\/Anatomy_of_a_Murder\">Anatomy of a Murder<\/a><\/i>, Welch suffered a\u00a0<a class=\"mw-redirect\" title=\"Heart attack\" href=\"https:\/\/en.wikipedia.org\/wiki\/Heart_attack\">heart attack<\/a>\u00a0and died on October 6, 1960.&#8221;<\/p>\n<p style=\"text-align: left;\">Which leads to a personal note: I just turned 69, and 16 days before <strong><em>my<\/em><\/strong> 70th birthday will be next June, 2021. So again:<strong><em> OMG!<\/em><\/strong>\u00a0On the other hand, I&#8217;m guessing that Judge Welch didn&#8217;t exercise seven hours a week like I do. <em>(Including yoga, weights and hour-bouts of stair-stepping, with a 30-pound weight vest and 10 pounds of ankle weights. For my part, I want to live to at least 120, like <a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=A2KLfS0a.GNfUfIA4o5pCWVH;_ylu=Y29sbwNiZjEEcG9zAzEEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1600415899\/RO=10\/RU=https%3a%2f%2fen.wikipedia.org%2fwiki%2fMoses\/RK=0\/RS=Rr1ix7qp6UBNfDHbMjFlo8AmTwA-\" target=\"_blank\" data-c13=\"5f63f81b2dc1f\">Moses<\/a>.) <\/em><\/p>\n<p style=\"text-align: left;\">But I&#8217;m not the only one &#8220;<a class=\" ac-algo fz-l ac-21th lh-24\" href=\"https:\/\/search.aol.com\/click\/_ylt=A2KLfSOfY2Vf_IIAmEBpCWVH;_ylu=Y29sbwNiZjEEcG9zAzEEdnRpZAMEc2VjA3Ny\/RV=2\/RE=1600508960\/RO=10\/RU=https%3a%2f%2fidioms.thefreedictionary.com%2fof%2ba%2bcertain%2bage\/RK=0\/RS=wDO34U8vSX0U_AmwHpVAiVMw1.8-\" target=\"_blank\" data-1c1=\"5f6563a0669d8\">of a certain age<\/a>&#8221; these days paying lots more attention to good habits, exercise and nutrition. He started life as &#8220;the wealthy heir to a hotel chain fortune,&#8221; and after the Army-McCarthy hearings went on to a career in Hollywood, most prominently as a firm producer.
